Statement
The privacy of our clients
personal information is of paramount importance to Gibson Killer Pty Ltd and
this policy sets out why we collect personal information and how we use the
information collected.
As a Financial Services Licensee the collection of personal information by our
company is required in order to provide our services to you.
The Federal Government amended the Privacy Act 1988 and these amendments
took effect from
21 December 2001
. This document addresses our
compliance with these changes in summary form.
WHY
WE COLLECT INFORMATION.
As mentioned above we collect information on our clients in order to provide our
services to you. As a provider of
advice, we have always been required by Federal Law to “know your client”
before providing any advice. This is
important as without knowing your personal situation Gibson Killer Pty Ltd will
not be in a position to provide you with personal advice in relation to matters
such as Tax, Superannuation, Centrelink, Veteran Affairs or investment risk.
Failure to collect sufficient information to ensure appropriate advice may lead
Gibson Killer Pty Ltd or its representatives to breach the Corporations Act
and/or the Rules of Professional Conduct of the Financial Planning Association.
HOW
WE COLLECT INFORMATION.
In the first instance Gibson Killer Pty Ltd will collect as much information as
possible on your personal position from you directly.
This information will include such detail as your full name, date of
birth, address, tax file number, Centrelink file number, financial position,
work particulars, contact details, marital position, estate details as well as
details of particular investments you hold.
It may also include your opinions or comments on particular investment
sectors.
Subject to the level of information you are able to provide we may also need to
gather additional information from a range of organisations such as your
Accountants, Tax Agents, Solicitor, Bank, Building Society, Insurance Company,
Fund Manager, Stockbroker or Share Registry service that you deal directly with.
Government departments such as the Tax Office, Centrelink and Veteran
Affairs may also be contacted for information.
If we need to contact any of these groups you will need to sign a Client
Authorisation Form.
Be assured that we will only collect personal information necessary for what we
do.
USE
OF INFORMATION COLLECTED.
Gibson Killer Pty Ltd will use the information collected to provide you with our
range of services, broadly described as Financial Planning advice.
STORAGE
OF INFORMATION.
Gibson Killer Pty Ltd have always been aware of the importance and sensitivity
of all information and documentation relating to clients.
As such the details are held in client files, within lockable filing
cabinets within the office. Public
access to this part of the office is not permitted.
As well as manual files, Gibson Killer Pty Ltd also hold personal particulars,
investment details and notations on computer databases and disks.
These databases are protected by passwords known only to staff and computer
disks with client files are stored in a locked key and combination safe.
DISCLOSURE
OF INFORMATION TO OTHER PARTIES.
Gibson Killer Pty Ltd do not disclose client names and/or client details to
anyone other than in the following situations :
We are required under the Rules of Professional Conduct of the Financial
Planning Association of Australia Limited to make certain information available
for inspection by the Association on request to ensure ongoing compliance with
mandatory professional standards.
We are also obliged pursuant to the Corporations Act to maintain certain
transaction records and make those records available for inspection by the
Australian Securities and Investments Commission.
Your authorisation will be sought prior to the disclosure of personal
information to any other parties such as Accountants, Solicitors etc.
DESTRUCTION
OF PERSONAL INFORMATION.
All literature etc relating to a client that is to be destroyed is shredded by a
member of staff so that it is no longer legible.
Due to legislative and professional requirements we are required to hold
records for a period of seven years.
OPTING
OUT.
If we send you any information such as newsletters, periodicals, research or
product offerings that you no longer wish to receive you can opt out by
telephoning our office on (07) 41531999.
If you no longer wish Gibson Killer Pty Ltd to provide you with ongoing advice
in relation to your financial matters and you would like all personal details
deleted and/or destroyed, you can do this by forwarding a signed letter to

ACCESS
AND CORRECTION.
If you ask, we will tell you what personal information we hold about you, and
what we do with it. We will
facilitate access to you by allowing an inspection of your personal information
in person, or by providing copies or a summary of relevant documents following
your request. Depending on the
request and other circumstances, such as the amount of photocopying etc a
reasonable charge may be levied.
If the information is inaccurate we will take reasonable steps to correct it.
If for some reason we refuse to provide access we will advise you of our
reasons for doing so.
HOW

Should you have any queries in relation to your personal information and our

If you have a query in relation to a possible breach of your privacy we will try
to resolve the issue in a timely manner. Should
we be unable to resolve your query to a satisfactory level please contact the
